General terms of sale

These General Terms of Sale (hereinafter "GTS") govern the terms of subscription to and use of the "Premium" subscription offered within the Passion Cocktail mobile application (hereinafter "the Application"). These GTS are supplemented by the General Terms of Use (GTU) accepted by the user on first use of the Application.

The purpose of these GTS is to define the terms of subscription, use and termination of the "Premium" subscription within the Application. The "Premium" subscription allows the user to access additional features not available in the free version of the Application.

Access to the "Premium" subscription requires the creation of a user account. The user must register via the Application by providing accurate, complete and up-to-date information. Once registered, the user is responsible for the confidentiality and security of their login information (username and password).

The user undertakes not to disclose their login information to a third party. In the event of failure to comply with this clause, Passion Cocktail reserves the right to suspend or terminate the subscription without notice or refund.

The "Premium" subscription is accessible via a monthly subscription. Once subscribed, the subscription automatically renews each month on the anniversary date of the subscription, unless terminated by the user before the renewal date.

The "Premium" subscription gives access to additional features specifically described in the Application at the time of subscription. These features may include, without limitation:

The price of the "Premium" subscription is specified at the time of subscription. This price is payable monthly and may be revised at any time by Passion Cocktail. In the event of a price change, the user will be informed at least 30 days before the new prices are applied. Maintaining the subscription after notification of the price change constitutes acceptance by the user.

Payment for the "Premium" subscription is made by automatic debit from the payment method associated with the user's account. The debit is made monthly on the initial subscription date.

In the event of payment failure (e.g. expired card, insufficient funds), access to the "Premium" features may be suspended until the situation is regularised. If payment is not regularised within a reasonable time, Passion Cocktail reserves the right to terminate the subscription.

The "Premium" subscription is non-refundable. Any subscription period that has begun is due in full, even in the event of early termination by the user or interruption of service due to the user's fault (in particular in the event of sharing login information with a third party).

The user may terminate their "Premium" subscription at any time via the Application. The termination takes effect at the end of the current monthly period. No sum will be refunded for the period already begun.

Passion Cocktail reserves the right to unilaterally and without notice terminate the subscription of any user in the event of a breach of these GTS, in particular in the event of failure to comply with the prohibition on sharing login information. No refund will be made in the event of termination for non-compliance with the GTS.

The user is responsible for the use they make of the "Premium" subscription and of the Application. They undertake not to allow third parties to access their account or the "Premium" features using their login information. Any fraudulent or unauthorised use of the account may result in suspension or termination of the subscription without compensation.

The user undertakes not to share their access to the "Premium" subscription with third parties, nor to disclose the exclusive information or content they access via this subscription. Any distribution, reproduction or transmission of the features and content reserved for "Premium" users, in any form whatsoever, is strictly prohibited. In the event of a breach of this prohibition, Passion Cocktail reserves the right to suspend or terminate the subscription without notice, and this without the possibility of a refund.

Passion Cocktail reserves the right to modify these GTS at any time. The modifications will be notified to the user by any appropriate means, in particular via the Application. Continued use of the "Premium" features after notification of the modifications constitutes acceptance of the new GTS.

These GTS are subject to French law. Any dispute relating to their interpretation or their performance will be submitted to the competent courts within the jurisdiction of the registered office of Passion Cocktail, unless there is a mandatory legal provision to the contrary.

These GTS supplement the General Terms of Use accepted by the user on first use of the Application. By subscribing to the "Premium" subscription, the user acknowledges having read and accepted these GTS without reservation.
